Valet Liability Contract

This contract limits our liability.

Vehicles are parked at the owner's risk. Epic is not responsible for mechanical failure, loss, or use of the vehicle, or a vehicle not picked up by the owner during hours of operation. Epic Valet is not responsible for any items left in the vehicle, closing convertible tops, nor lowered windows due to mechanical failure, and is only responsible for the ignition key. Customer assumes the risk of any inconspicuous damage, ground effects, flat tires, windshields, exhaust of the vehicle, aftermarket parts, and dirt/dust accumulation caused by the parking location. Due to the inherent difficulty in detecting door dings and minor cosmetic damage, Epic Valet shall not be held liable unless such damage is proven to be directly caused by the negligence of Epic Valet staff. Epic is not liable for vandalism or theft of the vehicle while in Epic's possession unless the loss was caused by an Epic employee. Customer agrees to inspect the vehicle before leaving the pickup location. Customer waives rights to all claims if the customer leaves the parking lot without submitting an incident report with Epic. No employee or agent can change the terms of this contract. If Epic assumes responsibility for any damage to the vehicle, Epic reserves the right to move or repair the vehicle at a place of Epic's choosing. If a customer fails to pick up the vehicle before closing, a note will be left on the windshield indicating the location of the keys. Keys are never left in the podium after hours.

Phone as key. If Epic Valet is required to use a customer's smartphone to start, unlock, or otherwise access a vehicle (for example, an app-based or digital key), Epic Valet is not liable for any damage to the phone.
